Cody Johnston’s trial is in court this week and into next; it began with jury selection on Monday, Oct. 17th at the Richland County Event Center. Johnston has been charged with deliberate homicide and tampering with physical evidence in connection with the disappearance of his estranged girlfriend Nicole Waller.
Waller was last seen in Fairview, MT on Feb. 14th, 2013 and her body has not been recovered. Waller’s vehicle was found abandoned off Highway 2 between Poplar and Wolf Point on Feb. 15th, 2013 and Waller was reported missing. She has not been heard from since.
Johnston was arrested in Sidney, MT on Aug. 24th, 2015; he was released on a $250,000 bond and has been residing in Flathead County while awaiting trial in Richland County, with the requirement of wearing a GPS tracking unit.
District Judge Elizabeth A. Best of the Eight Judicial District is presiding over the case, after District Judge Gregory Pinski recused himself earlier this year.
