Johnston's Trial is set for the Weeks of May 2nd and May 9th 2016

On Monday, October 26th Cody Johnston appeared in Richland County District Court before Presiding District Judge Greg Pinski from Cascade County via video conference. The Fairview man is charged with, and has pled not guilty to, deliberate homicide and tampering with physical evidence in regards to the 2013 disappearance of Nicole Waller.

Johnston's lawyers, Clark Mathews and Casey Moore, requested that Johnston's bail be reduced from $250,000 to $100,000 stating that Johnston has family in the area, ties to both Richland County and Flathead County, and doesn't have a criminal history, however Judge Pinski ruled against the motion and bail will remain at $250,000 due to the severity of the charges. Judge Pinski is still reviewing the motion to dismiss charges and will set a deadline for a request to change venue.

A trial date was set for the weeks of May 2nd and May 9th of 2016.
