Land Use Regulations Series – Did you Know

RV/mobile home parks, work camps to be reviewed by local cities and counties.

People from all over the United States are coming to the Bakken region looking for work and a place to live. Many who travel here bring their campers to live in while they seek employment and look for a place to call home. Oil companies and other businesses are also trying to secure temporary housing for their employees.

A few years ago Richland County did not have many recreational vehicles (RVs) in the area; there was only the seasonal traveler.

Due to the overwhelming number of RVs coming into the area, many community members provided a space for those looking for a place to park their unit. By doing this some people within the community have unknowingly violated Montana State Law and our local regulations.

Currently, according to the County’s Subdivision Regulations (section VII), when a parcel is used for an RV/mobile home park or work camp it is to be reviewed as a subdivision. When creating a park or camp the land remains under single ownership, while the spaces are rented.

The Board of Richland County Commission has adopted Temporary Workforce Housing Zoning Regulations that require minimum health and safety standards for man camps, crew camps, work camps, or crew housing facilities. Workforce housing facilities may include the use of skid units, travel trailers, recreational vehicles, campers, mobile homes, park models, modular homes or any combination of these. When approved and issued a Temporary Workforce Housing Conditional Use Permit is valid for up to five (5) years. At least 30 days prior to the expiration date the applicant may apply for renewal of the permit. According to both regulations, plans must be submitted prior to creating, renting, or leasing out any spaces.

The Richland County Attorney’s office has hired a Compliance Officer, Terry Murphy, to ensure RV/mobile home-park and work camp operators are in compliance with Montana State Statutes and local regulations. Mr. Murphy is working with landowners to help them gain compliance. Please contact the County Planner Office with any questions how to stay in compliance with these regulations.
